General Privacy Statement
At Marki Microwave we take your right to privacy seriously. We never sell your personal data to any third party.
This privacy policy describes how and why Marki Microwave, LLC. (“Marki,” “we,” or “us”), might collect, store, use, and/or share (collectively, “Process”) your information when you use our website and its online services and content (collectively, the “Site”). By the nature of our products Marki is primarily a business-to-business (“B2B”) company; our Site is directed at enterprises, government agencies, research institutions, and other organizations rather than individual consumers. Our Site includes both publicly available content and may also contain a subset of content found in a password-protected Registered User Portal (the “Portal”) available to visitors who register for access. If you do not agree with anything contained in this policy, please do not use the Site.
Information We Collect Automatically
What is Collected: For all users who visit our Site, we collect certain information automatically that includes, but may not be limited to, your Internet service provider, Internet protocol (IP) address, browser type and version, and operating system. Other information collected may include the date and time of your arrival at and departure from the Site, the names and web addresses of referring websites, the specific pages you choose to visit on the Site, and certain search terms that you may have employed to find the Site. See also our “Cookie” policy below for additional information.
Use: Information collected automatically from users is used only for purposes of review, by us and our Site administrative consultants, including tailoring pages to your specific technology environment, analyzing traffic and search trends, generating aggregate demographic information, and general Site administration.
Storage: We store and retain the information we collect for only as long as it is necessary for the legitimate business purpose(s) for which we originally collected it or as required by law.
Sharing Your Information: We do not sell any such automatically collected information. We may share this information with service providers contracted by us to assist with administration and operation of our Site, or otherwise as compelled by law.
Information You Provide to Us Voluntarily
Certain actions you take on the Site may result in you providing additional personal information to us. Examples of this include, but may not be limited to:
Registered User Portal
Marki Microwave operates a password-protected Registered User Portal (the “Portal”) offering access to certain restricted technical content, resources, and tools. To register for the Portal, you must create an account and provide certain personal information. At a minimum your business email address will be required for registration. Marki may also collect your full name, job title, industry sector, and country/location. By registering, and subject to any consent provided at the time of registration or updated subsequently, you acknowledge and agree that this information will be collected, stored, and used by Marki as described in this policy. The following additional terms apply to Portal registration and use:
Information from Third Parties
We may obtain personal information through partners, suppliers, and other third parties. The parties from whom we obtain information are typically in one of the following categories: advertising and marketing companies, data and information vendors, public database providers, social media platforms, business partners, providers of products or services, hosts or vendors at events or trade shows, and research partners. We take steps to confirm that information we receive from these third parties has been collected with your consent or that these parties are otherwise legally permitted to disclose your personal information to us. We might also obtain information via your use of the Site through a business partner, including our distribution partner, RFMW, Ltd., and via our Site analytics service providers. This kind of data is used to enhance our Site, online tools, and product offerings, respond to your inquiries, or conduct business transactions with you.
Children and Parents
Marki Microwave does not intend to collect personally identifiable information from children under age 13 without permission of the child’s parent or legal guardian. Children under the age of 13 should submit personally identifiable information to Marki Microwave only with the explicit permission of their parent or legal guardian. Our Site and Portal are directed at business and professional users and are not intended for use by minors. The Portal requires registrants to confirm they are at least 18 years of age. If your child has submitted personal information and you would like to request that such information be removed, you may do so as indicated below and Marki Microwave will use reasonable efforts to comply with your request.
Questions and Rights Regarding Your Personal Information
We seek to protect your personal data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of personal data and how we are processing that data.
If you have submitted personally identifiable information to Marki Microwave electronically and would like to understand more about what we do with it, or want it removed or modified, please contact us at [email protected]. We will use reasonable efforts to respond to your inquiries and comply with your request.
In addition to, and without limiting the general nature of the foregoing, if you are a resident in certain jurisdictions, you may have certain specific rights regarding your personal information as outlined below. If you are a resident or data subject in such a location, the more protective of the general obligations here, or the specific obligations under the respective jurisdictions’ law, will prevail.
California: If you are a California resident, you have the right to request certain information about our collection and use of your Personal Data over the past 12 months (categories of data collected, its sources, the business or commercial purpose for collecting, categories of third parties with whom we have shared your information, and specific personal data we have collected about you), to request its deletion subject to certain exceptions, and have the right to opt-out of the sale of your Personal Data. As further amended by the California Privacy Rights Act (“CPRA”), effective January 1, 2023, California residents also have: (a) the right to correct inaccurate personal information we hold about you; (b) the right to opt-out of the sharing of personal information for cross-context behavioral advertising; and (c) the right to limit use and disclosure of sensitive personal information. We do not sell or share your personal information for cross-context behavioral advertising purposes. We do not collect sensitive personal information (as defined under the CPRA) in connection with your use of our Site. Because Marki Microwave operates as a B2B business, much of the personal information we collect relates to individuals acting in a professional capacity on behalf of their employer or organization; certain CCPA/CPRA rights may apply differently in this context. If you have specific questions, or wish to exercise these rights, email us at [email protected].
Other U.S. State Privacy Laws: Certain other U.S. states have enacted comprehensive consumer privacy laws that may apply to residents of those states, including the Virginia Consumer Data Protection Act (“VCDPA”), the Colorado Privacy Act (“CPA”), the Connecticut Data Privacy Act (“CTDPA”), the Texas Data Privacy and Security Act (“TDPSA”), and similar laws. Because Marki Microwave is a B2B company, many obligations may be subject to B2B or employment exemptions; however, to the extent such laws apply to you, we will endeavor to honor the applicable rights, which typically include rights to access, correct, delete, and port your personal data, and to opt out of the sale or sharing of your personal data. To submit a request, please contact us at [email protected].
Europe: If you are a resident of the European Union (“EU”) and certain other European countries, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data. We will only process your Personal Data if we have a lawful basis for doing so, which pursuant to the GDPR may include:
As an EU data subject, you may request information about the types of personal data we hold about you, ask for a copy, rectify or correct it if it is incomplete or incorrect, request for it to be erased from our systems, withdraw an earlier consent for us to use your personal data, object to our further use or disclosure of your personal data, or restrict our further processing of your personal data. For more information about these rights, or to submit a request, please email us at [email protected].
Please note that in some circumstances, we may not be able to fully comply with your request, if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law. In those circumstances Marki will respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Data, as necessary to verify your identity and the nature of your request.
Cookies
The Site uses cookies and similar tracking technologies to enable our servers to recognize your web browser, understand how and when you visit, support site security, and analyze usage trends. Cookies are small pieces of data placed on your device when you access our Site. We use a consent management platform (Hu-manity.co Cookie Compliance) to obtain and record your consent preferences before setting any non-essential cookies. The following categories of cookies are used on our Site, with specific cookies identified in the Cookie Inventory table below:
Cookie Inventory
The following table identifies the specific cookies currently in use on our Site:
hu-consent – Set by: Hu-manity.co (our consent management platform). Category: Strictly Necessary. Purpose: Records and stores your cookie consent preferences (which categories you accepted or declined), the timestamp of your choice, and a session identifier. This cookie is the mechanism by which we document your consent as required by applicable law. It does not collect behavioral data or PII. Retention: Up to 12 months, after which the consent banner will re-appear. Consent required: No (it records consent – it is the consent cookie itself).
cf_clearance – Set by: Cloudflare, Inc. (our CDN and security provider). Category: Strictly Necessary. Purpose: Stores proof that a visitor has passed a Cloudflare bot or security challenge (such as a CAPTCHA), preventing the challenge from being re-triggered during a session. This cookie does not contain PII; it contains an encrypted session token that only Cloudflare can read. Cloudflare may process your IP address as part of providing CDN and security services; Cloudflare is certified under the EU-US Data Privacy Framework and provides Standard Contractual Clauses for international transfers. Retention: Session to a few days depending on configuration. Consent required: No (strictly necessary for site security). Third-party privacy policy: cloudflare.com/privacypolicy/.
_gcl_au, _gcl_aw (and related _gcl_* cookies) – Set by: Google LLC (via Google Ads Conversion Linker / Google Tag). Category: Advertising / Conversion Tracking. Purpose: These first-party cookies set on our domain store the Google Click Identifier (GCLID) from ad clicks, allowing Google Ads to attribute website conversions (e.g., form submissions, product inquiries) back to the specific ad campaign that drove the visit. _gcl_au is used for Google Ads conversion measurement and audience integration; _gcl_aw stores the specific ad click information. Data is transmitted to Google’s servers in the United States. We have implemented Google Consent Mode v2 so that these cookies are only set after you provide consent; when consent is denied, only anonymized, non-identifying signals are sent to enable aggregate conversion modeling. Retention: Up to 90 days. Consent required: Yes (advertising/non-essential). California residents may opt out via our “Do Not Sell or Share My Personal Information” link. Third-party privacy policy: policies.google.com/privacy.
_ga – Set by: Google LLC (Google Analytics 4). Category: Analytics. Purpose: Assigns a pseudonymous unique client identifier to your browser to distinguish individual users and sessions, and to measure traffic sources, page views, engagement metrics, and user behavior on our Site. Data (including your pseudonymous client ID and interaction data) is transmitted to Google’s servers. We have configured GA4 with IP anonymization enabled and data retention set to the minimum period adequate for our analytics needs. We have a signed Data Processing Agreement with Google. We have implemented Google Consent Mode v2: when consent is denied, the _ga cookie is not set, and GA4 uses aggregate modeling rather than individual tracking. Retention: 2 years. Consent required: Yes (analytics/non-essential). Third-party privacy policy and opt-out: policies.google.com/privacy; tools.google.com/dlpage/gaoptout.
_clsk – Set by: Microsoft Corporation (Microsoft Clarity). Category: Analytics / Behavioral. Purpose: A session-scoped cookie that groups a visitor’s actions during a single visit (such as page views and clicks) into one cohesive session recording. This enables Clarity’s session replay and funnel analysis features. While _clsk does not directly contain PII, the session data it enables may include behavioral sequences that constitute personal data under applicable privacy law. Microsoft Clarity automatically masks sensitive form fields. We have implemented Clarity’s Consent V2 API integrated with our consent management platform: _clsk is only set after analytics consent is granted; if consent is withdrawn, Clarity tracking stops. Retention: 1 day (session-scoped). Consent required: Yes (analytics/non-essential). Third-party privacy policy: privacy.microsoft.com/privacystatement.
_clck – Set by: Microsoft Corporation (Microsoft Clarity). Category: Analytics / Behavioral. Purpose: A persistent cookie that assigns a unique identifier to your browser to recognize you as a returning visitor across multiple visits to our Site. Unlike _clsk (which is session-scoped), _clck persists across sessions and enables Clarity to build longitudinal behavioral analytics on returning visitors. Because _clck is a persistent cross-session identifier, and because logged-in Portal users are identified individuals, use of _clck in combination with Portal registration data may constitute processing of identified personal data, to which full GDPR obligations apply. We have implemented Clarity’s Consent V2 API: _clck is only set after analytics consent is granted. Retention: 1 year. Consent required: Yes (analytics/non-essential). Third-party privacy policy: privacy.microsoft.com/privacystatement.
You can decide whether or not to accept Cookies through the consent banner presented when you first visit our Site. You may also manage or delete cookies through your browser settings; most browsers allow you to block or delete cookies. Note that blocking strictly necessary cookies (such as cf_clearance or authentication cookies) may prevent the Site or Portal from functioning correctly. Disabling analytics or advertising cookies will not affect your ability to browse the Site. Our Site does not respond to browser “Do Not Track” (DNT) signals; however, we honor the Global Privacy Control (GPC) signal as an opt-out of sale/sharing of personal information for California residents, as required by the CPRA.
Other Important Information
Transfer of Your Personal Data: The Marki Site is hosted and operated in the United States by Marki and its service providers. By using the Site, you acknowledge that any personal data about you, regardless of whether provided by you or obtained from a third party, is being provided to Marki in the U.S. and will be hosted on U.S. servers, and you authorize Marki to transfer, store and process your information to and in the U.S., and possibly other countries. Because Marki sells products worldwide, personal data we receive in connection with your business inquiries or orders (typical personally identifiable information arising from such engagements consist of incidental business contact information, in addition to the information that may be collected on the Marki website as described elsewhere herein) may be transferred to and processed in the United States. For international visitors, particularly those in the EU or UK, you acknowledge that the U.S. may not provide the same level of data protection as your home country. Where required by law, we will implement appropriate transfer mechanisms to lawfully transfer personal data from the EU/UK to the U.S.
Disclosure in Corporate Transactions: We may disclose personal information as part of a contemplated or actual corporate transaction such as a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings). We may also disclose your information to the extent such disclosure is compelled by applicable law or regulation.
Data Security: We implement reasonable and appropriate technical, physical, and administrative safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. However, no internet transmission or electronic storage system is completely secure, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you as required by applicable law.
Modification: Marki Microwave reserves the right to modify this privacy policy at any time. We will promptly reflect any such modifications on our website. For material changes to this policy, particularly those affecting how we process personal data collected through the Registered User Portal, we will provide advance notice to registered users by email (to the email address on file) or by a prominent notice on the Site. Your continued use of the Site or Portal after the effective date of any update constitutes your acceptance of the revised policy.
